Terms of Service

Effective Date: August 31, 2026

These Terms of Service ("Terms") govern all services provided by Lamyia J. Crawford, operating as The Solution Midwife™, through Breakthrough Strategy Solutions LLC ("the Company," "we," "us"). By booking a service, making a payment, or otherwise engaging the Company, the client ("you," "the Client") agrees to these Terms.

1. Services Provided

The Company provides strategic advisory, business formation and administrative support, documentation and writing support, website design and digital presence services, and related à la carte and maintenance services, as described on the Company's website and in individual service agreements or intake materials.

2. Scope of Services & Packages

Website design services are offered in tiered packages (Bronze, Silver, Gold, Platinum), each with a defined set of features and page/product limits as published on the Services page at the time of purchase. Package inclusions and pricing are subject to change without notice; the package description in effect at the time of a client's purchase governs that engagement.

3. Revisions Policy

Each website package includes a limited number of revision rounds:

  • • Bronze — 3 rounds of revisions
  • • Silver — 5 rounds of revisions
  • • Gold — 10 rounds of revisions
  • • Platinum — 15 rounds of revisions

Unlimited revisions are not available on any tier. Revisions beyond the included amount are billed à la carte at the Company's then-current rate. Corrections of genuine errors made by the Company are provided at no charge and do not count against the client's included revision allowance.

4. Payment Terms

Payment is due at the time of booking or purchase unless otherwise agreed in writing. Prices for all services are subject to change without notice; the price displayed or quoted at the time of purchase applies to that transaction. Payment plans, where offered, are provided through third-party services (e.g., Afterpay, Klarna, Affirm) and are subject to those providers' own terms. All payments are final. The Company does not offer refunds under any circumstances — no exceptions.

5. Design & Branding Scope

The Company does not provide graphic design, logo design, or visual branding/marketing graphics at any service tier or as an add-on. Clients are responsible for supplying their own brand identity (logos, colors, fonts) and site copy. Copywriting support is available separately through Documentation & Strategic Writing Support and is not bundled into website design packages.

6. Monthly Website Maintenance

Monthly website maintenance, where purchased, covers technical debugging only — broken functionality, plugin conflicts, site errors, and uptime issues. It does not include content edits, copy changes, design updates, or new features; these are billed à la carte or scoped as separate projects.

7. Third-Party Services & Costs

The Client is solely responsible for all costs associated with third-party services connected to their project, including but not limited to:

  • • Domain registration and renewal
  • • Web hosting
  • • Payment processor fees (e.g., Stripe)
  • • Print-on-demand or fulfillment provider costs (e.g., Printful, Lulu)
  • • Shipping and postage
  • • Email marketing and CRM subscriptions
  • • Virtual mailbox subscriptions
  • • Any other third-party subscriptions or services connected to the Client's site or business

Any accounts with third-party services set up as part of a Client's project are registered in the Client's own name and are the Client's responsibility to maintain and keep in good standing. The Company is not responsible for service interruptions, data loss, or account suspension resulting from unpaid or mismanaged third-party accounts.

8. Website Platform & Ownership

Client websites are built using Lovable, a third-party AI-assisted web application platform. Unless full project ownership has been formally transferred to the Client's own Lovable account, the Client's site is hosted under the Company's Lovable workspace, and the Company retains administrative access for ongoing edits and maintenance. Ownership transfer, where available, requires the Client to hold their own paid Lovable account and to independently reconfigure any tied third-party services (payment processing, domain, email, etc.).

9. Intellectual Property

Upon full payment, the Client owns the final visual design, content, and branding elements delivered as part of their specific project. This does not extend to any underlying software, code frameworks, templates, or methodologies developed or used by the Company, which remain the property of the Company unless a separate, explicit ownership transfer has been completed.

10. No Guarantee of Results

The Company does not guarantee specific business outcomes, search engine rankings, sales figures, lead volume, or any other measurable result from services rendered. Strategic recommendations are based on the Company's professional judgment and the information provided by the Client.

11. Professional Disclaimers

Certain services carry specific disclaimers:

  • • Business Contract Preparation is document preparation only, not legal advice or representation. Clients should have any document reviewed by a licensed attorney before signing.
  • • Business Credit & Banking Setup Guidance is educational and strategic guidance only, not financial advice, and does not guarantee approval for any credit, loan, or account.
  • • Personal Tax Filing Guidance is an educational walkthrough only, not tax preparation or tax advice, and is not a substitute for a licensed tax professional. The Client files their own return.
  • • The Free Clarity Call, Strategic Advisory, and related conversations are strategic business guidance only and do not constitute formal coaching, legal, medical, psychological, or other licensed professional advice.

12. Client Responsibilities

The Client agrees to provide timely feedback, requested content, and brand assets, and to complete any required intake or discovery materials prior to project commencement. Delays in providing required materials may affect project timelines and are not the responsibility of the Company.

13. Confidentiality

Both parties agree to keep confidential any proprietary, financial, or personal information disclosed in the course of the engagement, except as required by law or with the disclosing party's consent.

14. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, or consequential damages arising from services rendered, including but not limited to lost profits, lost data, or business interruption. The Company's total liability for any claim arising from a specific service shall not exceed the amount paid by the Client for that service.

15. Termination

Either party may terminate an engagement with written notice. The Client remains responsible for payment for all work completed up to the date of termination.

16. Governing Law

These Terms are governed by the laws of the State of Colorado, the state in which the Company is formed, without regard to conflict-of-law principles.

17. Changes to These Terms

The Company reserves the right to update these Terms of Service at any time. Continued use of the Company's services after changes are posted constitutes acceptance of the updated Terms.
